1. Acceptance of Terms

By creating an account, purchasing a pass, or using our facilities, you agree to be bound by these Terms of Service. If you do not agree, you may not use our services.

2. Service Description

The Cave Climbing provides indoor climbing facilities, bouldering walls, fitness classes, equipment rental, and related services at its locations in Saudi Arabia.

3. Account and Membership

  • Account registration requires accurate and current information. You must update your information if it changes.
  • You are responsible for maintaining the security of your account credentials.
  • One account per person. Accounts are non-transferable.
  • Passes and memberships are personal and non-transferable between individuals.

4. Assumption of Risk and Liability Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Nature of Activities

Indoor climbing, bouldering, fitness classes, and related activities involve inherent risks that cannot be eliminated without fundamentally altering the nature of the activity. These risks exist regardless of the care and precautions taken by The Cave Climbing and its staff.

Acknowledged Risks

By participating in any activity at our facilities, you acknowledge and accept the following risks, which include but are not limited to:

  • Falls from climbing walls or bouldering structures
  • Contact with climbing surfaces, holds, or other participants
  • Equipment failure or malfunction, whether rental or personal
  • Errors in belaying, spotting, or instruction
  • Overexertion, sprains, torn muscles and ligaments
  • Fractures or broken bones
  • Head, neck, and spinal injuries
  • Abrasions, contusions, cuts, and wounds
  • In extreme cases, serious injury or fatality

Voluntary Participation

By entering the climbing area and participating in any activity, you voluntarily assume all risks — both known and unknown, foreseeable and unforeseeable — arising from your participation.

Release of Liability

You release The Cave Climbing, its owners, operators, employees, instructors, and agents from any and all claims, demands, or causes of action arising from your participation in activities at our facilities, except in cases of gross negligence or willful misconduct.

Indemnification

You agree to indemnify and hold harmless The Cave Climbing against any claims brought by third parties arising from your actions or conduct on the premises.

Equipment

You are responsible for inspecting any equipment (whether rental or personal) before use. Report any defects to staff immediately. The Cave Climbing maintains equipment according to manufacturer specifications but does not guarantee against all equipment failure.

Rules Compliance

You agree to follow all posted rules, staff instructions, and safety guidelines at all times. Failure to comply may result in immediate removal from the facility without refund.

Medical Fitness

You confirm that you are physically fit to participate in climbing and fitness activities and have no medical conditions that would be aggravated by such activities. You are encouraged to consult a physician before participating.

Emergency Authorization

You authorize The Cave Climbing staff to seek emergency medical treatment on your behalf if you are unable to do so. You accept financial responsibility for any medical costs incurred as a result of such treatment.

5. Photography and Media Release

The Cave Climbing may photograph or record video and audio within its premises for promotional, marketing, social media, and operational purposes.

By entering our premises, you acknowledge that you may appear in such media. All photographs and recordings taken by The Cave Climbing on its premises remain the property of The Cave Climbing.

We will make best efforts to be considerate and respectful in the use of such media.

Removal requests: If you identify yourself in any published media and wish to have it removed, you may submit a request to privacy@theedge.sa. We will process removal requests within 30 days. Please note that removal applies to future use only; media already distributed to third parties or in print may not be retrievable.

This section does not apply to your own personal photos and videos taken on the premises for private, non-commercial use.

6. Class and Event Cancellation Policy

Cancellation by the Customer

Classes may be cancelled up to 2 hours before the scheduled start time for a full refund. Cancellations within 2 hours of the start time are not eligible for a refund but may be rescheduled to another available time slot. No-shows forfeit the booking.

Cancellation by The Cave Climbing

We reserve the right to cancel or reschedule classes due to insufficient enrollment, instructor unavailability, or operational reasons. Best efforts will be made to reschedule affected customers to an alternative available time slot.

Event Cancellation

For special events, cancellation terms will be stated at the time of booking. Unless otherwise specified, the standard class cancellation policy applies.

Force Majeure

Neither party shall be liable for cancellation or non-performance due to circumstances beyond reasonable control, including but not limited to government orders, natural disasters, and public health emergencies.

7. Purchases and Payments

  • All prices are in Saudi Riyals (SAR) and include VAT (15%) where applicable.
  • Payments are processed through third-party gateways (MyFatoorah, Tamara).
  • Day passes are valid for the date of purchase only.
  • Punch cards and subscription passes are subject to the expiry dates stated at the time of purchase.
  • Partially used passes are non-refundable.
  • Refunds for cancellations follow the cancellation policy outlined above.

8. Facility Rules

  • Follow all posted rules and staff instructions at all times.
  • No climbing without a valid pass or booking.
  • Appropriate athletic attire and closed-toe climbing shoes are required in climbing areas.
  • No food or drink in climbing areas.
  • The Cave Climbing reserves the right to refuse entry or remove any person for safety violations, disruptive behavior, or intoxication.

9. Limitation of Liability

  • To the maximum extent permitted by Saudi law, The Cave Climbing's total liability shall not exceed the amount paid by you for the specific service giving rise to the claim.
  • The Cave Climbing is not liable for indirect, incidental, or consequential damages.
  • Nothing in these terms limits liability for death or personal injury caused by gross negligence or willful misconduct.

10. Privacy

Your personal data is processed in accordance with our Privacy Policy, which forms part of these terms. By using our services, you acknowledge the data practices described therein.

11. Intellectual Property

All content on this platform — including logos, text, design, and software — is owned by The Cave Climbing or its licensors. You may not reproduce, distribute, or create derivative works without prior written consent.

12. Termination

We may suspend or terminate your account for violation of these terms, with or without notice. Upon termination, your right to use the platform ceases immediately. Data handling upon termination follows our Privacy Policy and PDPL requirements.

13. Governing Law and Disputes

These terms are governed by the laws of the Kingdom of Saudi Arabia. Any disputes arising from or related to these terms shall be resolved through the competent courts in Riyadh, Saudi Arabia.

14. Changes to Terms

We may update these terms from time to time. We will provide at least 30 days notice of material changes via email or platform notification. Continued use of our services after the effective date constitutes acceptance of the updated terms.
